1. U.S. Sales Tax Overview

Apex Container Group collects and remits sales tax on orders shipped to U.S. states where we have a sales tax obligation (nexus) as required by applicable state and local law.

Sales tax nexus is established through our physical presence (headquarters, depots, employees) and/or through economic nexus thresholds (revenue or transaction volume) in certain states, in accordance with the South Dakota v. Wayfair (2018) Supreme Court ruling.

1.1 States Where We Collect Sales Tax

We currently collect sales tax in all states where we have nexus. The specific states where we collect tax may change as our business operations evolve. Sales tax is calculated and applied automatically at checkout based on your delivery address.

We maintain full compliance with all applicable state sales tax laws and remit collected taxes to the appropriate state authorities on a regular schedule.

1.2 States Without Sales Tax

The following U.S. states do not impose a general state sales tax. If your container is delivered to one of these states, no state sales tax will be charged:

Note: Even in states without a state-level sales tax, some local jurisdictions may impose their own taxes. Our checkout system accounts for all applicable state, county, and municipal taxes based on the specific delivery address.

2. How Sales Tax Is Calculated

Sales tax is calculated automatically at checkout based on the following factors:

  • Delivery Address: The primary factor in determining your tax rate. Tax is based on the state, county, and municipality of your delivery address — not your billing address.
  • State Tax Rate: The base state sales tax rate for the state where your container will be delivered.
  • County & Local Tax: Additional county, city, or special district taxes that may apply in your delivery jurisdiction.
  • Product Type: In some states, certain types of equipment or tangible personal property may have different tax rates or exemptions. Shipping containers are generally classified as tangible personal property.
  • Delivery Charges: In states where delivery charges are taxable, sales tax is applied to the delivery fee as well (see Section 4).

3. Kansas Sales Tax

As a Kansas-based business headquartered at 1522 Sarratoy St, Pfeifer, KS 67660, the following Kansas-specific tax provisions apply:

  • Kansas State Rate: The Kansas state sales tax rate is currently 6.50%. This rate is set by the Kansas Department of Revenue and is subject to change by the state legislature.
  • County & Local Taxes: Additional county and local sales taxes may apply depending on the delivery location within Kansas. Combined rates in Kansas typically range from 7.50% to 11.50%.
  • Pfeifer / Ellis County: Orders delivered to our headquarters area in Ellis County, Kansas are subject to the Kansas state rate plus applicable Ellis County and local taxes.
  • Self-Pickup at HQ: If you pick up your container from our Pfeifer headquarters, Kansas sales tax based on our location will apply (unless a valid exemption certificate is provided).

4. Tax on Delivery Charges

Whether delivery charges are subject to sales tax depends on the state where the container is delivered. Tax treatment of delivery charges varies significantly by state:

Our checkout system automatically applies the correct tax treatment for delivery charges based on your delivery state. The tax on delivery (if applicable) will be clearly itemized on your invoice.

💡 Self-Pickup = No Delivery Tax

If you choose to pick up your container from one of our depot locations, no delivery charge is applied — and therefore no delivery tax. Sales tax will apply only to the container purchase price based on the depot location (or your exemption status).

5. Tax-Exempt Purchases

If you are a tax-exempt entity, you may purchase shipping containers without sales tax by providing a valid exemption or resale certificate. The following entities typically qualify for sales tax exemption:

  • Government Entities: Federal, state, and local government agencies and departments.
  • Non-Profit Organizations: Qualifying 501(c)(3) tax-exempt non-profit organizations with a valid state-issued exemption certificate.
  • Resellers: Businesses purchasing containers for resale who hold a valid resale certificate or reseller's permit for the delivery state.
  • Agricultural Exemptions: In some states, containers used directly in agricultural production may qualify for an agricultural exemption with proper documentation.
  • Manufacturing Exemptions: In certain states, containers used directly in the manufacturing process may qualify for a manufacturing equipment exemption.
  • Tribal Nations: Federally recognized tribal nations with appropriate tribal tax documentation.

5.1 How to Apply Your Tax Exemption

5.2 Important Tax-Exempt Rules

  • Before Payment: Your exemption certificate must be submitted and verified before you place your order. We cannot retroactively remove sales tax from a completed order.
  • State-Specific: Your certificate must be valid for the state where the container will be delivered. A Kansas resale certificate does not exempt you from Texas sales tax on a Texas delivery.
  • Multi-State Orders: If you are ordering containers for delivery to multiple states, you may need to provide separate exemption certificates for each delivery state.
  • Expiration: Some exemption certificates have expiration dates. If your certificate expires, you must provide an updated certificate to maintain tax-exempt status.
  • Misuse Liability: The buyer is solely responsible for the proper use of tax exemption certificates. Using an exemption certificate for purchases that do not qualify is a violation of state tax law and may result in penalties, interest, and back taxes assessed by the state.

🚫 No Retroactive Tax Refunds

We cannot refund sales tax after an order has been completed and paid. If you are tax-exempt, you must establish your exemption before placing your order. If you paid sales tax on an order that should have been exempt, you may file a claim directly with the state tax authority for a refund of the tax paid.

6. International Orders

Orders shipped to destinations outside the United States are not subject to U.S. sales tax. This includes all deliveries to:

  • European Union: All 27 EU member states
  • United Kingdom: England, Scotland, Wales, Northern Ireland
  • Other International: Any country outside the United States

While no U.S. sales tax is collected on international orders, the buyer may be responsible for import-related taxes and duties in their destination country. See Section 8 for full details on EU import duties and VAT.

7. Tax on Custom Containers

Custom-modified containers (offices, kiosks, homes, pools, retail spaces, etc.) are subject to the same sales tax rules as standard containers. The following applies:

  • Taxable Amount: Sales tax is calculated on the total project cost — including the base container, all materials, labor, and modifications. This is the industry-standard approach for tangible personal property that has been modified.
  • Deposit Payments: Sales tax is typically calculated on the full project cost and collected with the final balance payment, not on the initial deposit. However, this may vary by state.
  • Real Property Conversion: In some states, if a container is permanently affixed to real property (e.g., a container home on a foundation), it may be reclassified as real property and subject to different tax treatment. Consult your local tax authority or a tax professional for guidance.

⚠️ Container Homes & Permanent Structures

If you plan to permanently install your container as a home, office, or commercial building, the tax treatment may differ from a movable storage container. Some states distinguish between tangible personal property (movable containers) and real property improvements (permanently affixed structures). We recommend consulting with a local tax professional or your county assessor's office to understand the full tax implications of permanent container installations in your jurisdiction.

8. EU Import Duties & VAT

For orders shipped to European Union member states, no U.S. sales tax is charged. However, the following import-related taxes and fees may apply and are the buyer's responsibility:

🚫 Not Included in Our Prices

Import duties, VAT, and customs brokerage fees are not included in Apex Container Group's quoted prices. These charges are set by your country's customs and tax authorities and are completely outside our control. We strongly recommend consulting with a local customs broker before purchasing to understand the total landed cost of your container in your country.

To help facilitate smooth customs clearance, we provide all required export documents with every international shipment: Bill of Lading, Commercial Invoice, Packing List, Certificate of Origin, and CSC Plate Documentation. These documents are essential for your customs broker to process your import efficiently.

9. Tax Refunds & Corrections

If you believe sales tax was charged incorrectly on your order, the following options are available:

9.1 Tax Charged in Error by Apex

  • Incorrect Rate Applied: If our system charged a sales tax rate that does not match the actual rate for your delivery address, contact us at info@apexcontainergroup.com with your order number. We will review and issue a corrected invoice and refund any overcharge within 5–10 business days.
  • Tax Charged to Tax-Exempt Buyer: If you provided a valid exemption certificate before your order but tax was still charged, contact us immediately. We will issue a refund of the tax amount within 5–10 business days.
  • Tax-Free State: If you are in a state with no sales tax (Oregon, Delaware, Montana, New Hampshire, Alaska) and tax was charged, contact us for an immediate correction and refund.

9.2 Retroactive Exemption Claims

If you are tax-exempt but did not provide your certificate before your order, we cannot retroactively refund the sales tax. In this situation, you may:

  • File a claim directly with the state tax authority in the state where tax was collected for a refund of the sales tax paid
  • Provide your exemption certificate to us for all future orders so tax is not charged going forward

10. Record Keeping

We maintain detailed records of all sales tax collected and remitted in accordance with applicable state and federal requirements:

  • Tax Invoices: Every order invoice clearly itemizes the container price, delivery charge, sales tax amount, and total. Invoices are available in your account and sent via email.
  • Tax Remittance: Collected sales tax is remitted to the appropriate state tax authorities on a monthly or quarterly basis as required by each state.
  • Exemption Records: We retain copies of all exemption and resale certificates on file for the duration required by applicable law (typically 3–5 years).
  • Your Records: We recommend retaining your invoice and payment receipt for your own tax records. Businesses may deduct container purchases as a business expense — consult your tax advisor.

If you're in a tax-free state (Oregon, Delaware, Montana, New Hampshire) or are tax-exempt with a certificate on file, the tax amount will show as $0.

Unfortunately, no. We cannot retroactively refund sales tax on completed orders. Your exemption certificate must be submitted and verified before you place your order. If you paid tax that should have been exempt, you can file a refund claim directly with the state tax authority where the tax was collected.
